PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY SO THAT YOU ARE AWARE OF YOUR RIGHTS AND OBLIGATIONS TOWARDS THE APPLICABLE FAVE COMPANY IN YOUR JURISDICTION (FAVE ASIA TECHNOLOGIES SDN BHD (COMPANY REGISTRATION NO. 201101000765 (928899-V)) IN MALAYSIA AND BEECONOMIC SINGAPORE PTE. LTD. (UEN: 201002456D) IN SINGAPORE AND ITS RELATED COMPANIES, SUBSIDIARIES AND AFFILIATES (INDIVIDUALLY AND COLLECTIVELY, "FAVE", "WE", "US" OR "OUR") IN RESPECT OF THE ACCESS AND USE OF THE PLATFORM AND/OR SERVICES PROVIDED BY US.
BY ACCESSING THE PLATFORM, USING THE SERVICES AND/OR REGISTERING FOR AN ACCOUNT WITH US, YOU GIVE YOUR ACCEPTANCE OF AND CONSENT TO THESE TERMS OF USE, WHICH SHALL INCLUDE THOSE ADDITIONAL TERMS AND CONDITIONS AND POLICIES REFERENCED HEREIN AND/OR LINKED HERETO AND/OR IMPOSED BY US FROM TIME TO TIME. YOUR ACCEPTANCE OF THESE TERMS OF USE SHALL CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN FAVE AND YOU AS THE USER. IF YOU DO NOT AGREE WITH THESE TERMS OF USE, IN WHOLE OR IN PART, PLEASE DISCONTINUE ACCESSING AND USING THE PLATFORM, ACCOUNT AND/OR SERVICES IMMEDIATELY.
16C SPECIFIC T&C – GIFT CARD
16C.1 INTRODUCTION
(a) Gift Card is a digital card issued by participating merchants, available either with a predetermined denomination value, or, depending on the brand, with an option for you to specify a customized amount. It can be spent on goods and/or services only at the specific participating merchants (closed-loop) either offline (at retail outlets) or online (via the brand's website or app), subject to the applicable terms and conditions between you and your selected participating merchants.
(b) Your Gift Card purchase and/or transaction will be additionally governed by these Specific T&C and any other terms and conditions imposed by the respective participating merchants.
16C.2 GIFT CARD TRANSACTIONS
(a) The purchase and/or utilization of a Gift Card is contingent upon the terms and conditions outlined by each participating merchant. These Gift Cards are valid for use at all participating locations of the specific brand, whether offline (at retail outlets) or online (via the brand's website or app). Any restrictions or exceptions will be explicitly detailed in the terms & conditions specific to each Gift Card. We advise thoroughly reviewing the terms and conditions before finalizing your purchase.
(b) Where a Gift Card is issued in conjunction with any promotional and marketing activities (“Promotion Gift Card”), the use of such Promotion Gift Card shall be in accordance with any specific term and condition as may be prescribed by Fave and/or participating merchants from time to time.
(b) We merely act as a facilitator in providing the Platform to assist you in making the Gift Card purchases from the participating merchants. The Gift Card is issued by the respective participating merchants directly to you and Fave has no role to play in determining the usage, validity, extension, transferability and/or replacement of the Gift Card which is decided at the sole discretion of the participating merchants.
16C.3 PURCHASE & REDEMPTION OF GIFT CARD
(a) You would be able to access a comprehensive list of participating merchants offering gift cards along with the predetermined value of each card. Notwithstanding this and subject to some settings established by the participating merchants, you may also be able to determine the desired value of your Gift Card through the App by entering your chosen amount.
(b) Depending on the countries you are located in, payment for Gift Card purchases is supported via credit and debit cards, online banking/FPX and e-wallet. Fave reserves the absolute right to add and/or remove any existing payment methods from time to time without prior notice.
(c) You may only purchase one (1) Gift Card per transaction from your selected participating merchants. Gift Cards purchased can only be redeemed at the specific participating merchant (closed-loop) either offline (at retail outlets) or online (via the brand's website or app).
(d) Gift Card usage is governed by the terms and conditions set by each participating merchant. Certain Gift Cards require full redemption, while others permit partial redemptions and may be combined with ongoing promotions. Please refer to the specific terms and conditions provided by the participating merchant for detailed information on the use and redemption of your Gift Card.
(e) Gift Cards purchased cannot be topped up and/or reloaded. However, you may have the option to acquire additional units of the Gift Card subject to the terms and conditions imposed by the participating merchants.
(f) Your purchased Gift Cards are non-transferable and/or non-redeemable for cash or credit.
16C.4 VALIDITY OF GIFT CARD
(a) The validity of the Gift Card is determined by the participating merchants and cannot be extended by Fave.
(b) Upon expiry of the Gift Card:
(i) Any remaining stored value will be forfeited.
(ii) Fave will have no further responsibilities in respect of the Gift Card.
For the avoidance of doubt, Fave's role is solely in facilitating the sale and redemption of the Gift Card on our Platform, with no control and/or visibility post redemption.
16C.5 REFUND OR UNSUCCESSFUL TRANSACTION
(a) Gift Card purchased is strictly non-cancellable / non-refundable / non-exchangeable for cash and/or in any form of reimbursement
(b) However, in the event of:
(i) Deactivation and/or dysfunction of purchased gift card(s);
(ii) Delisting of the participating merchant from Fave's Platform;
(iii) System failure to generate the Gift Card code;
(iv) Non-availability of the Gift Card due to reason(s) communicated by the participating merchants; or
(v) Any other reasons approved by Fave's management
refund will be processed within 7-14 business days (excluding weekends and public holidays), depending on the issuing bank and the payment method you have selected.
(c) Fave shall not be held responsible for refunds arising from unsatisfactory goods and/or services purchased from participating merchants. Any refund requests initiated subsequent to Gift Card utilization must be directed to the respective merchants. Please refer to the refund policy outlined on the participating merchant's website and/or the terms and conditions set forth by the respective merchants.
(d) All refund requests under item (c) above must first reach the respective merchant for approval. Once you have acquired proof of payment and refund approval (supporting documents) from the merchant, you are required to share the supporting documents with us. We shall refund FINAL PRICE (less any handling fee or administrative charge chargeable at FAVE’s discretion) to you. All refund shall be made through the original payment method elected by you and may take up to 14 business days to process, depending on your source of payment.To facilitate the refund process, you shall ensure that the payment information and/or details are accurate as the default refund method depends on your original payment method.
16C.6 OTHER TERMS & CONDITIONS
(a) When completing your Gift Card purchase, you irrevocably acknowledge and agree that we may use all information, including personal and billing information, provided to us in the course of using the Services (“Payment Instructions”). You acknowledge and agree that it is your sole responsibility to ensure that all your Payment Instructions are correct, complete and accurate in every aspect and you understand that time is required to process your Payment Instructions. The Payment Instructions provided by you will be treated as final and we are not obliged to verify the Payment Instructions with you. Further, by providing us with your Payment Instructions, you agree to pay or authorise us to deduct from your Account all fees and charges associated with your Payment Instructions. For the avoidance of doubt, any concern, dispute or query in respect of Payment Instructions or the functionality of a selected payment method shall be resolved between you and the relevant financial institution, credit/debit card issuer and/or e-wallet operator.
(b) We shall not be responsible and will not assume liability for any losses, damages, reversals, fees, claims, penalties and/or chargebacks to you arising (including but not limited to) from authorized/unauthorized use of your account by you or third party, loss or damage of your mobile device, wrong information and details including payment information and/or card details entered by you or wrong remittance by you in connection with the payment for the purchase of Gift Card. We reserve all rights to verify whether you are duly authorised to use a certain payment method and we may suspend a payment transaction until such authorisation is confirmed or cancel such relevant transaction where such confirmation is not available.
(c) We shall also not be responsible and will not assume liability for any losses, damages, reversals, fees, claims, chargebacks and/or refunds to you arising from a merchant's failure to fulfill their obligations in relation to the Gift Card purchased and/or in the event of the merchant going out of business. While we will make best efforts to recover funds from the merchant, we shall not be liable to make any restitution to you for such claims or refunds. You hereby acknowledge and agree that your recourse for such matters lies directly with the merchant, and our involvement is limited to facilitating the recovery process at our discretion.
(d) Any chargeback requests must be promptly initiated by you upon discovery and/or realization of the need for such action. We strongly advise you to consult with your issuing bank to ascertain the precise process and timeline required for submitting such requests. Fave disclaims any responsibility for any damages and/or losses, howsoever arising that may arise from delays in filing chargeback requests.
(e) Cashback
Fave reserves the discretion to offer cashback for the purpose of Gift Cards.
16C.5 WARRANTIES
You hereby irrevocably acknowledge and agree that:
(a) we merely facilitate you to make the Gift Card purchase on behalf of the participating merchants;
(b) any and all information about the Gift Card are provided by the participating merchants to you;
(c) the participating merchant is the issuer of the Gift Card and the party responsible for ensuring the usage of the GiftCard for the purchase of its goods and services;
(d) the participating merchant, and not us, is solely responsible for the Gift Card purchased by you;
(e) the participating merchant is solely responsible for performing the warranty or honour the guarantee (if any) attached to the Gift Card purchased;
(f) any dispute arising in connection with the provision, fulfilment or performance of the Gift Card shall be resolved between you and the participating merchant only; and
(g) you have read and understood all additional terms and conditions including any terms and conditions by the participating merchants before completing your Gift Card purchase.
